Good news for JPSC candidates! HC stays govt decision to cancel 22 exams
Reacting to the High Court order, Jharkhand CLP leader Pradeep Yadav said the government will also respect the court's decision. He said that the entire situation will be revealed one by one only after the investigation and on the basis of that the way for further action will be clear. He also said that prima facie the government must have apprehended some malpractices in the examinations, on the basis of which the decision to cancel the examinations was taken. However, he also sympathised with the candidates who have secured jobs by putting in hard work and according to the financial capacity of their families.
Ranchi. A crucial hearing was held in the Jharkhand High Court on Thursday on the petitions filed against the state government's decision to cancel the Jharkhand Public Service Commission (JPSC) examinations and the appointments made on their basis. During the hearing, the high court, in a major relief to the petitioners, stayed the government's order under which 22 recruitment exams conducted by JPSC and an external agency were cancelled. Also, 23 other examinations were ordered to be examined.
The state government had issued a notification on Tuesday, August 18, cancelling these exams. After this decision of the government, there was a huge dissatisfaction among the selected candidates and the candidates doing the job. Many students have been protesting against the government's decision.
"My job is done, how did you snatch it without investigation? '
Impressed by the government's decision, one of the successful candidates said that taking away the job without any concrete investigation and proving the allegations at the individual level is injustice to them. The candidate says that if the role of any candidate is doubtful, then action should be taken against him on the basis of evidence, but it is not fair to consider all the successful candidates guilty together.
Candidates say that they took the exam as per the prescribed procedure, secured a place in merit and got appointment after selection. A large number of selected candidates have also contributed to government service. In such a situation, the sudden cancellation of appointments has created a serious crisis on their future and employment.
What did the petitioners say?
The petitioners have challenged the government's decision in the Supreme Court. They argue that the government did not give enough opportunity to the affected candidates to present their side before cancelling the examination and appointment.
The petitioners said that if any particular candidate, officer or procedural lapses are found in the investigation, action can be taken against the guilty as per law. But it cannot be justified to cancel the examination and appointment of all successful candidates without completing the scrutiny.
"I respect the court's decision," he said.

Now what next?
After the High Court's stay, immediate relief has come to the candidates whose examination or appointment was affected by the government's order. Now in the next legal process of the case, it will be important to decide how the alleged irregularities in the examinations will be investigated and on whom the responsibility will be fixed if the irregularities are found.
At present, the High Court's order has created a situation of immediate relief on the crisis created by JPSC candidates regarding jobs and appointments. At the same time, it will now be important for the government to investigate the alleged irregularities in the examination and clarify the further course of action on legal criteria.
