130th Constitutional Amendment Bill 2025- If the Prime Minister and Chief Minister remain in custody for 30 days, they will be removed from their posts

Union Home Minister Amit Shah introduced the 130th Constitution Amendment Bill, 2025, the Government of Union Territories Amendment Bill, 2025 and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2025 in the Lok Sabha today. The Bills provide that if a Minister of the Union Council of Ministers, Chief Minister or Minister of States is arrested for serious offences punishable with imprisonment of not less than five years and is detained continuously for 30 days, he shall be removed from office on the 31st day. Significantly, this rule will also apply to other big central ministers like the Prime Minister, Home Minister. So far, there is no provision in the rules for the resignation of a chief minister or a minister if he is arrested or jailed. However, the bill will not be passed today. It will be sent to a select committee of Parliament.
There are at least two such examples in politics that can explain the importance of this bill. Arvind Kejriwal spent 156 days in Tihar Jail in connection with the liquor scam but did not resign from the post of Delhi Chief Minister.
